Introduction and Scope of Application

These General Conditions of Sale govern the purchase of products marketed on the website www.mkm.it.

It is defined:

  • Consumer (or User): The Buyer, whether a natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity (art. 3, paragraph 1, letter a, Legislative Decree 206/2005).

  • Professional: The Buyer, whether a natural or legal person who acts in the exercise of their entrepreneurial, commercial, artisanal or professional activity (art. 3, paragraph 1, letter c, Legislative Decree 206/2005).

Note: The protections provided in favor of the Consumer do not apply to purchases made by Professionals, including the 14-day Right of Withdrawal and the 24-month Legal Guarantee of Conformity.

1. Product Information and Images

  • The product images on the website are for illustrative and representative purposes only. Small variations in color or finish (especially for natural materials or handcrafted workmanship) compared to the actual item do not constitute a defect.

  • MKM reserves the right to make technical and aesthetic changes or improvements to the Products without prior notice, promptly updating the information on the website.

2. Prices and Payment Methods

  • All prices indicated on the site are expressed in Euro (€) and are inclusive of legal VAT, unless otherwise specified.

  • All prices are ExW and shipping costs and any additional costs are the responsibility of the Buyer.

  • The accepted payment methods are:

    • Credit / Debit Card (Visa, Mastercard, etc.)

    • PayPal

    • Advance bank transfer (the order will be processed once the funds are actually credited)

3. Conclusion of the Contract and Shipping

  • The sales contract is considered concluded when the Buyer receives the order confirmation from MKM via e-mail.

  • Shipments are made by express courier to the addresses indicated by the User during the purchase procedure. The times indicated on the site are estimated and not essential.

4. Right of Withdrawal

4.1 Terms and Conditions

The following Terms and Conditions do not apply to purchases made by Professionals.

The right of withdrawal does not apply to purchases of personalized or custom-made products (including, but not limited to, all products for which engraving services have been performed), perishable products, or sealed products that, for safety or health reasons, cannot be returned once opened.

Pursuant to Article 52 et seq. of Legislative Decree 206/2005 (Consumer Code), the Consumer has the right to withdraw from the contract without stating a reason and without penalty within 14 (fourteen) days from the day on which he or she takes physical possession of the product.

To exercise the right of withdrawal, the Consumer must send an explicit declaration before the 14-day deadline by email to info@mkm.it, specifying:

  • Buyer's Name and Surname

  • Order/Invoice Number and Date

  • Item Code(s) being returned

4.2 Returns and Costs

If the return of the product is authorized, MKM will provide the Consumer with the Return Authorization Number (RMA No.) by email.

  • The Consumer must return the goods to MKM within 14 days of receiving the Return Authorization Number (RMA No.) to:

  • Use only traceable shipping methods (e.g., FedEx, UPS, DHL).

  • Enter a nominal value of the goods, if required, up to a maximum of EUR/US$ 10.00.

  • The Return Merchandise Authorization (RMA) number must be clearly indicated on the package containing the return. Shipments without a Return Merchandise Authorization (RMA) number will be refused.

  • The direct cost of returning the goods is the responsibility of the Consumer, unless otherwise indicated by MKM.

  • The risk of any damage or loss (theft, loss, or damage to the product), whether direct or indirect, is borne by the Consumer.

4.3 Refund

In the event of a valid withdrawal, MKM will refund the product price paid at the time of purchase (excluding shipping costs) within 14 days of being informed of the decision to withdraw.

  • MKM reserves the right to withhold the refund until it has received the goods.

  • For products offered with free shipping, a flat rate of €10 will be retained for shipments within Italy, €20 for shipments within the European Union, and €30 for shipments to the rest of the world.

  • Customs clearance costs or any certifications required for the sale of products shipped outside the European Union will also be retained.

  • The refund will be made using the same payment method used by the User for the initial transaction, unless otherwise agreed.

4.4 Liability for Handling

The Consumer is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.

  • The product must be returned:

    • Intact and unused.

    • Complete with all its accessories, manuals, and original packaging.

    • In its original, undamaged packaging.

  • If the returned product is: damaged (e.g., with signs of wear, scratches, deformation, etc.) or not complete with all its parts and accessories, including the original external/internal packaging, the return of the product will not be accepted and the product will be made available to the Consumer at MKM's headquarters.

5. Legal Guarantee of Conformity - Warranty

MKM guarantees that its products are free from defects in materials or workmanship.

This warranty does not cover defects resulting from:

  • improper or inappropriate use (modifications made by the Buyer, incorrect use, incorrect/lack of maintenance, etc.),

  • indirect damages or damages resulting from force majeure,

  • defects attributable to natural wear and tear.

5.1 For Consumers (B2C)

Products purchased by the Consumer benefit from the Legal Guarantee of Conformity provided for by Articles 128 et seq. of the Consumer Code (Legislative Decree 206/2005, coordinated with Legislative Decree 170/2021):

  • The warranty covers defects of conformity that become apparent within 2 (two) years of delivery of the goods.

5.2 For Professionals (B2B)

Purchases made by individuals who qualify as Professionals are subject to the warranties for defects in the goods sold as provided for by the Italian Civil Code (Articles 1490 et seq.).

  • The warranty covers defects of conformity, with a limitation period of 8 days from discovery for reporting the defect, and a statute of limitations for claims within 1 year from delivery.

5.3 Terms and Conditions

To exercise the right to the Warranty, the Buyer must send an email to info@mkm.it within the indicated timeframe, specifying:

  • Name and Surname of the Buyer

  • Order/Invoice Number and Date

  • Item Code(s) being returned

  • Indication of the defect and/or non-conformity found

  • Indication of the method of use (if used)

  • At least 1 image/video of the product defect.

5.3 Returns and Expenses

If the product is authorized for return, MKM will provide the Buyer with a return authorization number (RMA No.) via email.

Authorization to return the Products does not constitute acknowledgement of defects or nonconformities, the existence of which must be verified after the return.

If the defect or nonconformity is acknowledged, MKM reserves the right to repair or replace the product if still in production or if parts are still available, or to refund the price paid for the product at the time of purchase. Repairs or replacements will not interrupt or cancel the current warranty period.

  • The Buyer must return the goods to MKM within 14 days of receiving the return authorization number (RMA No.) to:

  • The direct costs of returning the goods are the responsibility of the Buyer, unless otherwise indicated by MKM.

  • The risk of any damage or loss (theft, loss, or damage to the product), whether direct or indirect, resulting from delays or failure to deliver the products, including products held at collection points in the event the end user was unable to receive the product, or any other circumstances not directly attributable to MKM, shall be borne by the Buyer.

5.4 Refund

In the event of a refund, MKM will refund the price of the product paid at the time of purchase (excluding shipping costs) within 14 days of the defect or non-conformity being discovered, following the return.

  • Customs clearance costs or any certifications required for the sale of products shipped outside the European Union will also be deducted.

  • Refunds will be made using the same payment method used by the User for the initial transaction, unless otherwise agreed.

6. Applicable Law and Jurisdiction

  • The sales contract is governed by Italian law.

  • Any dispute relating to the application, execution, and interpretation of these Terms and Conditions shall be subject to the exclusive jurisdiction of the Court of Pordenone.

7.    Discount Coupon


 

7.1 Terms and conditions
The discount coupon is strictly personal, non-transferable, and may not be combined with other promotions, offers, discounts, or ongoing initiatives, unless expressly authorized in writing by MKM.
Under no circumstances may the coupon be converted into cash, credit, or any other form of compensation. Any improper use will result in its immediate and permanent invalidation.
MKM reserves the right, at its sole discretion, to amend, replace, or revoke the coupon and/or these terms at any time, without prior notice.
The discount applies exclusively to the product price, expressly excluding taxes, customs duties, shipping costs, and/or any additional fees or charges.
The scope of the coupon may be limited to specific brands, items, or product categories, as determined by MKM.
Use of the coupon does not in any case imply free shipping. Additional fees or taxes may apply depending on the destination country of the goods.
The validity of the coupon is subject to product availability within the promotion and remains effective until the allocated quantities have been exhausted.
Specific conditions and additional restrictions may be established by the seller in relation to individual products, services, or promotions, and shall prevail in the event of any conflict with these provisions.
